Terms of Service

Welcome to Techwillow. Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Techwillow website and platform (the "Service") operated by Techwillow Inc. ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Agreement to Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. This agreement constitutes a legally binding contract between you and Techwillow.

2. Description of Service

Techwillow provides an AI-powered educational platform designed to assist parents and educators in generating curriculum-aligned worksheets for students in Grades 1-12. The Service includes:

  • Worksheet Generation: AI-based tools to create custom worksheets based on Ontario Curriculum standards.
  • Dashboard: A management interface for tracking child progress and organizing generated content.
  • Resource Library: Access to educational materials and templates.

We reserve the right to modify, suspend, or discontinue any part of the Service specifically at any time, with or without notice.

3. Accounts and Security

3.1 Account Creation

When you create an account with us, you adhere to the following:

  • You must provide accurate, complete, and current information.
  • You have the legal capacity to enter into a binding contract.
  • You will not create an account for anyone other than yourself or your child without their permission.

3.2 Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscriptions, Payments, and Billing

4.1 Subscription Plans

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select.

4.2 Billing Information

You must provide us with valid, up-to-date credit card information. By submitting such payment information, you automatically authorize us to charge all Subscription fees incurred through your account to any such payment instruments.

4.3 Cancellation and Refunds

You may cancel your Subscription renewal either through your online account management page or by contacting our customer support team. Refunds for Subscriptions are generally not provided for partial subscription periods but may be considered on a case-by-case basis at our sole discretion.

5. Intellectual Property Rights

5.1 Our Content

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Techwillow Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of Canada and foreign countries.

5.2 Your Content

You retain all rights to the specific worksheets and content you generate using our Service for your personal, non-commercial use. You adhere that you have the right to use any input data you provide to the AI system.

6. User Conduct and Acceptable Use

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.
  • To exploit, harm, or attempt to exploit or harm minors in any way.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate Techwillow, a Techwillow employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Techwillow or users of the Service or expose them to liability.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

8. Limitation of Liability

In no event shall Techwillow, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Formatting and Availability

We do not guarantee that the generated worksheets will be error-free or suitable for every specific educational context. The AI-generated content should be reviewed by a parent or educator before use. We are not responsible for any educational outcomes resulting from the use of our materials.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
